Assumpsit

Assumpsit, strictly, the voluntary promise by which a man takes upon himself to do an act or make a payment; but the term has come to be applied to the form of action brought to recover damages for the breach of a promise where the performance of such promise has not been secured by deed or writing under seal. Assumpsit is the most common form of action in the United States.
